Invitation to Participate in the Commission of the Canada Energy Regulator’s Rules of Practice and Procedure Review

You are invited to participate in a regulatory engagement for the Commission of the Canada Energy Regulator’s Rules of Practice and Procedure (the Rules).    

Background  

 The National Energy Board Rules of Practice and Procedure, 1995 govern the procedures to be followed during Commission hearings at the Canada Energy Regulator (CER), previously the National Energy Board. They set out the mechanisms for complaints, the conduct of public hearings, and determine the manner in which applications are to be reviewed. The Rules are made by the Commission under the Canadian Energy Regulator Act (CER Act) (section 35). 

A comprehensive update to the Rules is needed to align with the CER Act, which came into force in 2019. The update will reflect the CER’s new governance structure, and formalize the practices, processes, and terminology which have evolved since the Rules were first in effect under the former National Energy Board.   

Areas of Focus 

The objective of the Rules Review is to deliver regulations that:  

  • align with the CER Act, including the objectives outlined in the Act’s preamble, such as our commitment to Reconciliation;  
  • enhance competitiveness through predictable and timely processes; and  
  • modernize practices and procedures.  

Discussion Paper has been posted to highlight potential changes and improvements to the Rules with questions for your input by 9 December, 2024. You can submit your written comments directly to the CER by email to RPPR@cer-rec.gc.ca or by mailed letter (click here).   

Engagement Design Survey: Please let us know how you would like to participate in the Rules Review

CER would like the format of engagements to be responsive to the preference of those we are engaging with. To help us understand your preferences we are requesting that you fill out the Engagement Design Survey (link below) by 9 October 2024. Following this survey, we will review the results, and schedule and organize engagement sessions and deliverables accordingly. The survey results will be used for internal planning purposes only and will not be shared externally.
